Terms of Sale and Use

Updated October 14, 2026

Effective [EFFECTIVE DATE]. Last updated October 14, 2026.

These terms are the agreement between you and Prairie Post Seed Co. LLC, a Missouri limited liability company based in St. Charles County, Missouri (“Prairie Post,” “we,” “us”). They cover your use of prairiepostseed.com and every order you place with us directly: on our website, by email, by phone or in person. By placing an order or using the site, you agree to them.

We wrote them to be read. If anything is unclear, email hello@prairiepostseed.com and we’ll explain.

1. Policies that are part of these terms

These policies are part of these terms:

If one of those policies and these terms disagree, the more specific policy controls for its subject.

Orders placed on Etsy are governed by Etsy’s own terms and policies and by our Etsy shop policies. Our Grow Guarantee covers packets bought on Etsy too.

2. Who can order

  • You must be 18 or older (or the age of majority where you live) and able to make a binding contract.
  • We ship only to addresses in the contiguous United States and Washington, D.C., and for now not to Colorado, Kentucky, Minnesota, Nebraska, Ohio, Pennsylvania or Wisconsin, which require seed permits we don’t have yet. We do not ship to Alaska, Hawaii, U.S. territories, military APO/FPO/DPO addresses or other countries. Shipping & Returns has the details.
  • Our products are made for home gardens and gift-giving by adults. They are not designed or marketed for children.

3. About our seeds

  • Seeds are living things. The back of every packet shows the species, the lot number, the germination test result and test date, the amount of seed, the year it was packed for and a sell-by date. That label is our promise about what’s inside.
  • Results depend on more than seed. Germination and growth also depend on timing, weather, soil, moisture, light, animals and care, which we don’t control. Many Missouri natives need a winter chill before they sprout, and some take more than one season to come up. Our guides explain how to give them their best start.
  • Growing facts are typical ranges. Heights, bloom times, light and soil needs, and wildlife notes come from published sources such as the Missouri Botanical Garden and the Missouri Department of Conservation. They describe how a species usually grows, not a promise for your garden.
  • “Missouri native” means the species grows naturally in Missouri. Our plants grow best in the Midwest and nearby states. If you garden somewhere else, check that a species suits your area before you plant it.
  • Germination figures come only from the tested results printed on each label. We don’t promise germination beyond those results.
  • Drawings, not photos. Our plant, packet and kit images are illustrations. Printed colors, kraft paper and envelopes vary a little from batch to batch.

4. Seed and plant safety

  • Seeds are for planting only. They are not food. Don’t eat them or sprout them for eating.
  • Keep seed packets where children and pets can’t get to them.
  • Milkweeds (Nos. 4, 5 and 6) have a milky sap that can irritate skin and eyes, and they are toxic if eaten. Wear gloves when you cut them, wash your hands afterward, and keep pets and livestock from grazing them.
  • Some other native plants can also be harmful if eaten. If you’re unsure whether a plant is safe for your household or animals, ask your veterinarian or the ASPCA Animal Poison Control Center before you plant.
  • Common Milkweed (No. 6) spreads by underground roots. Give it room, or choose Butterfly Milkweed (No. 4) or Swamp Milkweed (No. 5) for small beds.

5. Prices, payment and taxes

  • Prices are in U.S. dollars and are shown before you pay.
  • Stripe processes our online payments. We never see or store your full card number.
  • We collect Missouri sales tax on orders delivered in Missouri, and sales tax in any other state where the law requires us to collect it. Tax is shown at checkout before you pay.
  • Promotion codes: one code per order unless the offer says otherwise. Codes have no cash value, can’t be applied to past orders, and may expire. A code used on a Seed Club membership applies to the first year only unless the offer says otherwise.
  • If a price or description on our site is wrong, we’ll either cancel the order and refund you in full or ask whether you’d like it at the correct price. We will never charge you more than the total you approved without your OK.

6. Placing, changing and canceling an order

  • When you finish checkout, Stripe charges your payment method and emails you a receipt. We email you again when your order ships.
  • We may decline or cancel an order, for example if the address is outside our shipping area, an item is out of stock, a price was wrong, or the order looks fraudulent. If we do, we refund you in full.
  • Online orders are limited to 20 of any one item. For larger quantities, see our business packets or wholesale accounts.
  • Need to change or cancel? Email orders@prairiepostseed.com right away. If we haven’t packed your order yet, we’ll change or cancel it and refund any difference. Once it ships, our Shipping & Returns policy applies.

7. Shipping, title and risk of loss

Shipping times and rates are in Shipping & Returns. Title to your order passes to you when we hand it to the carrier. That doesn’t change our promise to replace or refund an order that is lost or arrives damaged, as that policy explains.

8. Grow Guarantee

If a packet doesn’t come up after you follow our growing guide, tell us within 12 months and we’ll send a replacement packet. The Grow Guarantee is a limited warranty. Its full terms, including what it covers and how to make a claim, are in the Grow Guarantee.

9. Seed Club

The Seed Club is a yearly subscription. It renews automatically at $54 a year (plus any sales tax) until you cancel. You can cancel online at any time. The Seed Club Terms explain mailings, reminders, cancellation and refunds.

10. Business packets, Pop-By Kits and wholesale

Custom seed packets and Pop-By Kits follow our Business Packet Terms. Shops that buy our products to resell them follow our Wholesale Terms.

11. Gifts and gift notes

  • Gift notes are free, up to 200 characters. We print them as you type them, so please check spelling and names.
  • We may leave out a gift note that is threatening, hateful or obscene, or that shares someone’s private information. If we do, we’ll tell you.
  • For gift orders, the buyer is our customer for refunds. Gift recipients can use the Grow Guarantee directly and can exchange unopened items as Shipping & Returns explains.

12. Using our website

Please don’t use our site to break the law; try to reach parts of the site or our systems that aren’t meant for you; overload or interfere with the site; copy content or prices in bulk with bots or scrapers; send spam, malware or false information through our forms; or pretend to be someone else. We may block access or cancel orders that break these rules.

13. Our name, designs and content

The Prairie Post Seed Co. name and postmark logo are our trademarks. The Missouri Native Series stamp designs, our botanical illustrations, guides, photos and text belong to Prairie Post Seed Co. LLC or are used with permission. They are protected by trademark law and, where it applies, copyright law.

You’re welcome to print our guides for your own garden, link to our pages, and share photos of your packets and plants. Please don’t copy, sell or reuse our designs, illustrations or text for any commercial purpose without our written permission.

14. What you send us

  • You keep ownership of anything you send us, such as messages, photos, logos and garden stories. You give us permission to use it to answer you and to fill your order.
  • We won’t post your photos, name or words publicly without asking you first.
  • If you send ideas or suggestions, we may use them without owing you anything.

15. Reviews

We never post fake reviews, buy reviews or hide honest ones, and we don’t offer anything in exchange for a review. If we ask you for a review, saying no is fine. This follows the Federal Trade Commission’s rule on consumer reviews and testimonials (16 CFR Part 465).

We link to other sites, such as the Missouri Department of Conservation and Grow Native!, because they’re useful. We don’t control those sites and aren’t responsible for them.

17. Warranties

Products. The Grow Guarantee is our written limited warranty for our seed packets. Any implied warranties on our products, including the implied warranties of merchantability and fitness for a particular purpose, last only 12 months from the date you receive the product. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Website and information. We work to keep our site and guides accurate and available, but growing information is general guidance and the site is provided “as is.” We don’t promise it will always be available or free of errors.

18. Limits on our liability

To the fullest extent the law allows:

  • We are not liable for incidental or consequential damages arising from our products or this site, such as the cost of soil, containers, labor, other plants or landscaping, or the loss of a crop or planting.
  • Our total liability for any claim is limited to the amount you paid us for the product or order the claim is about.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Nothing in these terms limits liability that the law does not allow us to limit, such as liability for fraud, or takes away rights you have under consumer protection laws, including the Missouri Merchandising Practices Act.

19. If something goes wrong

  1. Talk to us first. Email hello@prairiepostseed.com with your order number and what happened. Most problems are solved with one reply. Please give us 30 days to make it right before you file a claim.
  2. Small claims court. Either of us may bring an individual claim in small claims court if it qualifies.
  3. Governing law and courts. Missouri law and applicable federal law govern these terms, without regard to conflict-of-laws rules. Any other dispute will be decided in the state courts located in St. Charles County, Missouri, or in the U.S. District Court for the Eastern District of Missouri, and both of us agree to those courts’ jurisdiction. If you are a consumer, you keep any rights under your home state’s laws that cannot be waived by contract.

20. Notice for California residents

Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

21. Email and electronic records

You agree that we may send order confirmations, receipts, shipping notices, Seed Club notices and policy updates by email, and that these electronic records count as being “in writing.” If you’d like a paper copy of any of them, ask and we’ll mail one free. We send marketing email only if you sign up for it, and you can unsubscribe at any time.

22. Accessibility

We want everyone to be able to shop with us. If any part of our site is hard to use with your device or assistive technology, email hello@prairiepostseed.com or call [PHONE]. We’ll help you place your order and work to fix the problem.

23. Changes to these terms

We may update these terms from time to time. We’ll post the new version on this page with a new “last updated” date. Changes apply to orders placed after the update. If you’re a Seed Club member, we’ll email you before a material change applies to your next renewal, as the Seed Club Terms explain.

24. The fine print

  • Whole agreement. These terms and the policies listed in section 1 are the whole agreement between us about their subject.
  • Severability. If a court finds part of these terms unenforceable, the rest stays in effect, and the unenforceable part is limited only as much as needed.
  • No waiver. If we don’t enforce a provision right away, we can still enforce it later.
  • Transfer. We may transfer these terms to a company that takes over our business. You may not transfer them without our written consent.
  • Events beyond our control. We aren’t responsible for delays or failures caused by events we can’t reasonably control, such as severe weather, crop failures or seed shortages, carrier or postal delays, power or internet outages, illness, or government action. If one of these keeps us from filling your order, we’ll tell you and refund you for anything we can’t send.
  • Words. Headings are for convenience. “Including” means “including without limitation.”
  • Survival. Sections 13 through 19 and 24 continue to apply after your order is complete.
